RALVE — Terms of Use (draft)

1. Who we are and what RALVE is

RALVE is a platform that lets physical video game collectors catalog their collection, share it publicly, and buy and sell items directly between each other (peer-to-peer). The platform is owned by RALVE, a brand operated by Roberto Gómez, holder of Spanish national ID (DNI) 04226092A, domiciled in Ávila, Spain, contact at hola@playralve.com.

By registering and using RALVE, you accept these Terms of Use in full.

2. Who can use RALVE

You must be at least 18 years old, or the legal age of majority in your country of residence, to register and use RALVE.
You must provide real, truthful information when registering (first name, last name, email, country). We reserve the right to suspend accounts with false information.
You are responsible for keeping your password confidential and for all activity that occurs on your account.

3. Nature of the service: we are a technology intermediary, not a party to the sale

RALVE provides the platform, the catalog, the verification tools and the messaging system — but we are never the buyer or seller in any transaction. Sale agreements (price, delivery/shipping method, conditions) are made directly between users. RALVE is not responsible for the fulfillment of those agreements between individuals, without prejudice to the moderation and verification measures we provide to encourage trust.

4. The verification system (RalveProof) and authenticity declarations

RalveProof calculates a confidence level for an item's completeness and authenticity, based on structured data (catalog codes, declared condition, photos). It is not an absolute guarantee of authenticity — it is a trust signal that helps buyers and sellers make an informed decision, never a definitive verdict.
When a seller declares an item to be original, they do so under their own responsibility. Falsely declaring an item to be original when it is not may result in account suspension and, in serious cases, legal liability toward affected third parties.

5. Seller obligations

Describe the item truthfully (condition, completeness, platform, region).
Never knowingly list counterfeit items, or hide relevant information about an item's real condition.
Comply with the conditions agreed with the buyer.

6. Buyer obligations

Act in good faith during negotiation and the agreed payment.
Use the messaging and reporting system to resolve disputes before pursuing other means.

7. User-generated content

By uploading photos, cataloging your library or publishing listings, you retain ownership of that content, but you grant RALVE a non-exclusive license to display it within the platform (including your public profile, if you enable it).
You must not upload content that infringes third-party rights, is illegal, defamatory, or contrary to these Terms.

8. Prohibited conduct

Creating fake accounts or using bots to manipulate the catalog, badges, rankings or reviews.
Reporting other users' content in bad faith (e.g., to harm a competitor).
Harassment, spam, or using the platform for purposes other than intended.
Attempting to gain unauthorized access to RALVE accounts, data or systems.

Non-compliance may result in account suspension or closure, without prejudice to any other legal action that may apply.

9. Intellectual property

The RALVE brand, its design and its code are the property of RALVE, a brand operated by Roberto Gómez.
The names, cover art and data of the video games appearing in the catalog are the property of their respective owners (studios, publishers, platform holders). RALVE claims no rights over those trademarks or content, and their use is limited to the descriptive identification of items within the catalog.

10. Fees and payments

PENDING — to be completed when in-app fee/payment collection is activated. During the beta phase, RALVE does not charge any fee on transactions.

11. Limitation of liability

RALVE is provided "as is" and "as available". We do not guarantee that the service will be free of errors or interruptions. To the extent permitted by law, RALVE will not be liable for damages arising from transactions between users, the accuracy of verification data, or content published by third parties.

12. Changes to these Terms

We may update these Terms at any time. We will notify substantial changes with reasonable advance notice, through the platform or by email.

13. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals of Ávila, without prejudice to any consumer rights you may be entitled to in your place of residence.
